The ex-lawyer for the former president has stepped down as New Jersey's top federal prosecutor. This comes after a legal ruling that invalidated her eligibility to hold the office.

Attorney General's Statement

US Attorney General, Pam Bondi, accepted her stepping down on Monday. She commented that the court's "flawed" ruling made it impossible for her to perform her duties.

"Let no one confuse compliance for surrender," Habba stated. "My fight will now extend throughout America."

Court Ruling

Habba's exit was triggered by a US appeals court determined that she had been unlawfully serving as the top prosecutor. This ruling is expected to impact numerous legal proceedings in the Garden State.

The court said that a temporary posting that did not receive the advice and consent of the Senate breached the federal law governing appointments.

Bondi said that the former prosecutor will continue working within the justice department as a senior adviser. They intend to challenge the decision of the ruling, aiming for a reversal.

On a social media platform, the Attorney General contended that the court "should not be able to second-guess the executive's selection of lawyers tasked with carrying out the fundamental role of the presidency of prosecuting crime."

Bondi highlighted her tenure and noted that while she was in charge, the Newark saw a significant drop in criminal activity. She also stated that the city of Camden had its initial homicide-free summer since 1974 with no murders.

The 41-year-old attorney, first joined Donald Trump's lawyers in recent years. She later defended her client in his New York criminal case in 2024, which resulted in his conviction on 34 counts of falsifying business records.

Earlier, Habba took on the federal prosecutor position, the former president had stated he was selecting her as his senior adviser in a potential future term, calling her as a steadfast ally and a dedicated fighter for justice.
